Lemon Law 101

Three Things the Dealer Won't Tell You

A lemon is any car they can't fix.

New or used, bought or leased. If it's under warranty and the dealer keeps failing to repair the same defect, or it's been sitting in the shop 30 days or more, California's Song-Beverly Act calls that a lemon.

The manufacturer pays. Including our fee.

The law makes them cover your attorney's fees when you win. That's not a marketing gimmick, it's written into the statute. It's why we never charge you a dime out of pocket.

Every extra month helps them, not you.

The clock generally runs four years, and repair records fade. The dealer knows this. The sooner you call, the stronger your paper trail and the bigger your leverage.

How It Works

Four Steps. We Handle All of Them.

You've done enough driving back and forth to the dealership. From here, the errands are ours.

1

Free Review

Tell us about the car. Takes a minute, costs nothing, obligates you to nothing.

2

We Build It

We pull the repair orders and warranty records and build a paper trail the manufacturer can't argue with.

3

We Negotiate

We push for the maximum the law allows: buyback, replacement, or cash. They know we'll litigate.

4

You Get Paid

You get the check. The manufacturer gets the car back. We call that a fair trade.

What You Can Recover

Three Ways This Ends Well

However it plays out, you stop paying for a car that never worked.

Full Refund (Buyback)

They buy the car back: purchase price, taxes, registration, the fees. You hand over the keys and walk away.

Replacement Vehicle

Same car, except this one actually works. A comparable replacement, on the manufacturer.

Cash Compensation

Keep the car, take a settlement for the defect. Sometimes with civil penalties stacked on top.

This tool gives a rough, illustrative estimate based on a simplified California buyback formula (purchase price minus a statutory mileage-usage offset). Actual recoveries vary widely and may include a replacement vehicle, cash-and-keep, incidental costs, or civil penalties. Nothing here is legal advice or a promise of results. Only a case review can tell you what you may actually be owed.

Questions & Answers

California Lemon Law FAQ

Straight answers to what drivers ask us most.

What is the California lemon law?
California's lemon law, the Song-Beverly Consumer Warranty Act, protects buyers and lessees of new and used vehicles still under warranty. If the manufacturer can't repair a substantial defect after a reasonable number of attempts, you may be entitled to a refund (buyback), a replacement vehicle, or cash compensation.
How much does a lemon law attorney cost?
Nothing out of pocket. Under California law, the manufacturer pays your attorney's fees when your case succeeds. We work on contingency, there's no fee unless we win your case.
Does the lemon law cover used cars?
Yes. Used vehicles can qualify if they were sold with a warranty, including a manufacturer's powertrain warranty or a certified pre-owned (CPO) warranty, and the defect arose while coverage was active.
How many repair attempts make my car a lemon?
There's no single magic number, but generally: two or more attempts for a serious safety defect, four or more attempts for the same problem, or 30+ cumulative days out of service can support a claim. We'll evaluate your specific situation for free.
How long do I have to file a claim in California?
The statute of limitations is generally four years, but it's best to act quickly. The sooner you contact us, the stronger your documentation and your case.
Do you serve my city in California?
Yes, we represent clients throughout the entire state of California, from Los Angeles and San Diego to the Bay Area, Central Valley, and beyond. See the service areas below.
